DWI Penalties
If you are charged with a New Jersey DUI, the penalties are steep.
This is not without merit; as you have read, drinking and driving is
extremely dangerous. The following penalties apply to New Jersey DUI
cases:
First offense, BAC of 0.08% - 0.10%
- $250 - $400 in immediate fines
- $3,000 in surcharges paid over the course of 3 years
- $200 in fines to go toward the DWI Enforcement Fund
- $50 in fines to go toward the Violent Crime Compensation Board Fund
- $75 in fines to go toward the Safe Neighborhood Fund
- $200 in fines to go toward the New Jersey MVC
- $150 Intoxicated Driver Resource Center fee
- Up to $33 in court costs
- 12 to 48 hours over the course of at least two 6-hour days at the Intoxicated Driver Resource Center
- Up to 30 days in prison
- Loss of license for 3 months
First offense, BAC of 0.10% or more OR under the influence of
drugs
- $300 - $500 in immediate fines
- All of the additional surcharges, fines, and fees listed above
- 12 to 48 hours over the course of at least two 6-hour days at the Intoxicated Driver Resource Center
- Up to 30 days in prison
- Loss of license for 7 to 12 months
- Possible 6 to 12 months with an Ignition Interlock Device
Second offense
- $500 - $1000 in immediate fines
- All of the additional surcharges, fines, and fees listed above
- 2 to 90 days in prison
- Loss of license for 2 years
- 1 – 3 years with an Ignition Interlock Device OR 2 years registration revocation
- 30 days of community service
Third offense
- $1000 in immediate fines
- All of the additional surcharges, fines, and fees listed above
- Possible additional $500 per year for three years surcharge
- At least 6 months in prison
- Loss of license for 10 years
- 1 – 3 years with an Ignition Interlock Device OR 10 years registration revocation (or a combination)
