Implied Consent

New Jersey has an implied consent law. That means that all New Jersey drivers, simply be getting behind the wheel, are agreeing to participate in a chemical test. You can politely refuse a field sobriety test if you want, but it is against the law to refuse a chemical test. If you do, your license will be automatically suspended and you’ll be charged with a New Jersey DUI.
